Recent Changes to Child Support Law

On January 1, 2011, two changes in the child support guidelines of our state went into effect. The first allows for a parent to receive a credit if they pay for daycare that is "work-related." The allowable daycare expenses can be up to $5,000 a year for one child, $9,000 for two children, and $12,000 for three children or more. Daycare expenses due to education or training are also covered under the law. The issues surrounding child support can become complicated, and are often one of the most contentious issues in a divorce. The court makes decisions about this issue based upon several criteria. These include which person was most involved in raising the children, the parental rights of both parents, the income of each parent, and the standard of living that was enjoyed by the children during the term of the marriage. In many cases, there will be no child support awarded, as the children will have their time split between the parents. In other cases, health insurance is an issue that must be resolved with regard to which parent will be responsible for keeping payments current.
